Why do I need a Lead Based Paint Inspection?

Lead paint is banned because lead is a toxic metal that can cause 1) Brain damage, 2) developmental delays, 3) intellectual disabilities, and 4) poor performance especially in children. The Louisville City Council passed an Ordinance which establishes Chapter 167 of the LMCO and states that all properties built before 1978 must be Lead-Safe or Lead-Free or the property may not be used as a long-term rental. What is the timeline for submitting Lead-Based Paint Inspection Results?

-The inspection must be complete, and a Lead Hazard Control Report must be submitted based on the following timetable:

* Properties built before 1940: Due 11/30/2025

* Properties built between 1940-1965: Due 11/30/2026

* Properties built between 1966-1978: Due 11/30/2027

- Properties must be retested every 3 years at a minimum unless determined to be lead-free

What does a Lead-Safe inspection involve?

- All Lead-Safe Inspections must be completed by a Certified Lead Risk Assessor. These inspections involve a minimum of 4 components

* Visual Inspection of the Grounds

* Visual Inspection of the Exterior surfaces

* Visual Inspection of the Interior surfaces

* Dust Swap testing of floors and window sills

- Additional samples must be taken if the visible inspections fail

- All samples must be submitted to EPA certified labs

Does the city conduct the inspections?

- No. You as the property owner are required to hire a Certified Lead Risk Assessor to complete the evaluation and Lead Hazard Control Report. That being said, all of the Louisville Metro Code Enforcement Inspectors are trained to identify lead hazards. You will likely receive Violation notices that point out areas of concern

Am I able to do the inspections myself with online test kits?

- No. Only Certified Lead Risk Assessors are qualified to do the inspections and all samples must be submitted to EPA Certified Labs per the Ordinance

Where is Lead found in a property?

- Lead can be found in the soil especially around the foundation of homes that were painted with LBP in the past. Bare spots in the yard can be a tell-tale sign and will require testing if present

- Lead based paint can be found on the exterior of homes. Depending on the exterior surface, it can found on walls, soffits, foundations, porches, and around doors and windows

- Lead based paint on the interior of homes is most likely around doors and windows, baseboards, and on basement walls

- Lead dust can become airborne when disturbed and can settle on window sills or be tracked into the home

How do I know if I am ready for a Lead Inspection?

- We recommend a pre-inspection to identify any areas of concern (AOCs). Once the AOCs are addressed, a full inspection can be completed

What is the difference between Lead-Safe and Lead-Free designations?

- A property designated as Lead-Free will either have to be tested again in 10-years (Temporary) or not have to be testing again (Permanent). This designation requires the determination that there is no lead paint in the property. The inspection typically involves an XRF test that penetrates all layers of paint. A home designated as Lead-Safe will have to be inspected every three years at a minimum

What happens if I don’t complete the inspection process before the deadline?

- Per the Ordinance, the property cannot be leased or offered for lease. If you do so, you are subject to a $500 fine that can increase by $500 per occurrence up to $2000. Each day is a separate occurrence

What happens if a child resident tests positive for Elevated Blood Levels (EBL)

- Once a child tests positive for EBL, a more thorough Risk Assessment must be conducted. This involves samples from all areas of the house
